Terms and Conditions for Early Edu AI Services

Welcome to our Early Edu AI Teacher Assistant Application (hereinafter referred to as "the Application"). This User Agreement (hereinafter referred to as "Agreement") is a legal agreement between you and Early Edu AI regarding your use of the Application. Please read this Agreement carefully before using the Application.

By registering, accessing, or using the Application, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you do not agree to any terms of this Agreement, please do not use the Application.

1. Service Description

1.1 The Application is an AI-assisted platform designed for early childhood educators, aimed at helping teachers generate observation records, teaching plans, and other educational support content through AI technology.

1.2 We reserve the right to modify, suspend, or terminate any part of the Application at any time without prior notice.

1.3 Some features of the Application may require payment to access. For paid services, specific fees and service details will be clearly communicated prior to purchase.

2. User Registration and Accounts

2.1 You must be at least 18 years of age and a professional educator to create an account and use the Application.

2.2 When registering, you must provide true, accurate, complete, and up-to-date personal information.

2.3 You are responsible for maintaining the security of your account password and for all activities conducted through your account.

2.4 You should immediately notify us of any unauthorised use of your account.

2.5 We reserve the right to refuse account registration, cancel accounts, or restrict use of the Application without prior notice.

3. Privacy Policy

3.1 We respect your privacy and the confidentiality of educational content you upload. Our collection, use, and protection of your information are detailed in our Privacy Policy.

3.2 Types of information we collect include:

  • Registration information (such as name, email, phone number, educational institution)
  • Photos or text descriptions you upload (for generating observation records and teaching plans)
  • Usage data (such as access times, features used, number of records generated)
  • Device information (such as IP address, browser type, operating system)

3.3 We use the collected information to:

  • Provide, maintain, and improve our services
  • Personalise AI assistance features
  • Communicate with you (such as service notifications, updates)
  • Analyse user behaviour to optimise our services

3.4 We will not sell your personal information or uploaded content to third parties. In some cases, we may share information with third-party service providers, but only to the extent necessary to provide you with services.

3.5 We implement security measures compliant with Australia's Privacy Act 1988 and New Zealand's Privacy Act 2020 to protect your personal information and uploaded content from unauthorised access, use, or disclosure.

4. Student Information Protection

4.1 The Application recognises and respects your professional responsibility as an educator when handling student information.

4.2 Important Declaration: This Application does not store or collect any children's personal information, especially photographs.

  • Photos or text descriptions containing student information that you upload are only used for immediate AI analysis
  • This data is not permanently stored on our servers or any third-party servers
  • After analysis is completed, all related data is immediately deleted
  • Our system design ensures maximum protection of children's privacy

4.3 We recommend that when uploading photos or descriptions, you:

  • Avoid including information that directly identifies students
  • Consider using pseudonyms or numbers instead of students' real names
  • Ensure you have proper authorisation to upload content related to students
  • Comply with your institution's policies regarding student data sharing

4.4 Our system design ensures that:

  • Your uploaded content is only used to generate the educational support materials you request
  • Content is not used to train our AI systems
  • Data is processed in accordance with Australian and New Zealand data retention regulations after service termination
  • Appropriate technical and organisational measures are implemented to protect uploaded student-related information

4.5 We commit to complying with the Australian Privacy Principles (APPs) under Australia's Privacy Act 1988, the Information Privacy Principles (IPPs) under New Zealand's Privacy Act 2020, and other privacy regulations applicable to educational institutions.

5. User Code of Conduct

5.1 When using the Application, you agree not to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights or other rights of others
  • Upload or transmit harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise inappropriate content
  • Interfere with or disrupt the normal operation of the Application
  • Access the Application's systems or networks without authorisation
  • Engage in fraudulent, misleading, or dishonest activities

5.2 In the event of a violation of the above code of conduct, we reserve the right to remove relevant content, suspend, or terminate your account.

6. Intellectual Property

6.1 The Application and all its content (including but not limited to text, images, audio, video, trademarks, code) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

6.2 We grant you a limited, non-exclusive, non-transferable licence to use the Application solely for personal, non-commercial purposes.

6.3 Without our express written permission, you may not:

  • Copy, modify, distribute, display, perform, or create derivative works of the Application's content
  • Remove or modify any copyright, trademark, or other proprietary rights notices on the Application
  • Use any part of the Application for commercial purposes

6.4 User-generated content: If you upload or share content on the Application, you retain all rights to that content, but you grant us a worldwide, non-exclusive, royalty-free licence to use, copy, modify, distribute, and display that content for the purpose of providing and improving our services.

7. Disclaimer

7.1 The Application is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied.

7.2 We do not guarantee that the Application will be uninterrupted, timely, secure, or error-free, nor do we guarantee that defects will be corrected.

7.3 The educational content provided by the Application is for reference only and should not be considered a substitute for professional judgement. Educators should always supervise and review the generated content.

7.4 To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages resulting from the use or inability to use the Application.

8. Amendments to Terms of Service

8.1 We reserve the right to modify this Agreement at any time. Modified agreements will be posted on the Application.

8.2 Your continued use of the Application after modifications constitutes acceptance of the modified Agreement.

8.3 If you do not agree with the modified Agreement, you should cease using the Application.

8.4 For significant changes, we will notify you via email or in-application notification.

9. Service Termination Conditions

9.1 You may terminate this Agreement at any time by ceasing to use the Application or deleting your account.

9.2 We may suspend or terminate your account in the following circumstances:

  • You violate any terms of this Agreement
  • We believe your behaviour may cause harm to the Application, other users, or third parties
  • You misuse the Application or our resources
  • We are required to do so by law

9.3 After account termination, your access to the Application will be revoked, and we may delete your account information and content, though we may retain certain information as required by law or for legitimate business purposes.

10. Dispute Resolution Mechanism

10.2 We will make our best effort to resolve your issue within 30 days.

10.3 Any disputes related to this Agreement should first be resolved through friendly negotiation.

10.4 If negotiations fail, both parties agree to resolve the dispute through arbitration, the results of which shall be binding on both parties.

11. Applicable Law

11.1 This Agreement is governed by and interpreted in accordance with the laws of Australia and New Zealand.

11.2 If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall continue to be effective.

12. Professional Responsibility

12.1 As an education professional, you understand and commit to complying with all applicable policies and regulations regarding student privacy protection in your institution and jurisdiction.

12.2 You confirm that you have appropriate authorisation to use the Application to generate content related to your teaching work.

12.3 You are responsible for reviewing content generated by the Application to ensure its accuracy, appropriateness, and compliance with your institution's educational standards.

13. Content Ownership and Usage

13.1 Ownership of teaching plans and observation records generated through the Application belongs to you and/or your educational institution.

13.2 You are free to:

  • Modify, edit, and adjust the generated content
  • Integrate the content into your teaching work
  • Share the content with colleagues and administrators according to your institution's policies

13.3 You may not redistribute or sell the generated content as a commercial product.

14. Content Quality and Accuracy

14.1 While we strive to ensure that the Application generates high-quality content that meets educational standards, as an AI assistance tool, we cannot guarantee that all generated content will be completely accurate or applicable in all situations.

14.2 You should always rely on your professional judgement to review and appropriately adjust the generated content.

14.3 We regularly improve our AI systems to enhance the accuracy and educational value of generated content.

15. Cross-Border Data Transfer

15.1 If you are located in Australia or New Zealand, you understand and agree that information you provide may be transferred to, stored in, or processed on servers located in Australia and New Zealand.

15.2 We will implement appropriate technical and organisational measures to ensure that such data transfers comply with applicable privacy regulations and maintain a level of protection equivalent to local data protection laws in Australia and New Zealand.
